Marmite on toast is an end-of-month culinary reality that The Point is familiar with. It is tempting to blame fiscal mismanagement, but (given that the menu for the rest of the month is cheese on toast) I suspect it has more to do with the fact that people who write words for a living don't get paid very much at all.

The Point is thankful for this marmite-on-toast situation for two reasons.

  1. It is better than no marmite and no toast.
  2. When politicians who get paid big fat salaries threaten to pull a Robin Hood, I am not struck by an irrepressible urge to move my assets to another country. This may very well be because I have no assets. At least, not the kind that can be redeemed for cash.

Meet South Africa's Robin Hood wannabe: Social Development Minister Bathabile Dlamini. She comes not with bows and tights, but with promises of higher taxes.

"We should have a society where those with resources are willing to give to those that have nothing and in the end we all win."

Call me a capitalist, but I'm not entirely sold. I'm not suggesting that those with resources get to sit counting their gold all day while the poor dream of eating marmite on toast, but surely if those with resources (and the know-how to produce more resources) give all of their resources to those without, in the end we will all be poor.

"This may require increased levels of taxation for the rich and it will require the captains of industry and investors to accept lower profits so that their workers may enjoy higher and, dare I say it, decent work."

Oh, sure, that's totally going to happen. Or — and I'm just brainstorming here — the captains of industry and investors are going to tell the South African government to get lost in a Floydian way before pumping their resources and cash into another country.

But perhaps The Point is looking at this in the wrong way. Perhaps, if The Point had vast amounts of money, The Point would realise that all that you need to do is figure out how to live in the conditions of capitalism whilst fighting it and defeating it.

Take, for example, the Munchkin. In his short life he has managed to accumulate a house in Sandton, a farm, and a Mercedes. He may or may not also be building a house which may or may not be costing R16-milion. The Point suspects a few Robin-Hood-like transactions may have taken place.

So, now that he has acquired these trappings of capitalism, Jujukins has declared that he is ready to give them up should it be in the public interest.

"I've got a house here in Sandton. If tomorrow they say, that house, there is a need for a street to pass there and therefore they are expropriating it, I would not have a problem."

That may because you would still have, at the very least, a farm.

"I've got a farm with cattle... if I go home and they say they want to build a school, if it is in public interest, I would surrender it."

The Point advises "them" (whoever they might be) to get on that straight away. But, in the meantime, I would like to draw your attention to a little detail which would result in the Death of Capitalism.

"That house you [the media] always make a noise about in Sandton — not the one you allege I'm building — it's owned by Absa. And if I fail to pay for it, for sure, Maria Ramos would be very happy she's taking a house from a man who's leading a nationalisation campaign, because she does not want nationalisation."

Malemalogic: Bank-owned property + expropriation = banks being totally screwed = Death of Capitalism.

This is a man, dear readers, who is deemed to be creditworthy, not only by the country's easily influenced youth, but also by one of the country's major banks.

The Butcher of Words

On the topic of reputations, Zapiro's has been attacked by a commission which has yet to establish one. Yip, it would appear that the Commission for the Promotion and Protection of the rights of Cultural, Religious and Linguistic Communities is upset that the cartoonist is picking on the president. The Point is still trying to figure out what a Linguistic Community is and why it would require protection.

"It is culturally, religiously and linguistically unprecedented to attack each other on the basis of a forgiven past," said the commission's chief executive Pheagane Moreroa.

Erm... did that sentence make sense to anybody else? I understand each of the words (something I suspect Moreroa does not), but not how they fit together. Zapiro certainly isn't attacking HRH Msholozi on the "basis of a forgiven past". If anything, he is attacking him on the basis of an un-forgiven present. And that, certainly, is not unprecedented. Linguistically or otherwise.

"Mr Shapiro displays an unbelievable insensitivity to cultural sensibilities of all decent-minded people. His cartoons on the president appear to be calculated to attack the psyche of a people emerging from a shameless past in which successive oppressive regimes ruled."

A shameless past? Surely, surely, even someone with Moreroa's misguided linguistic skills can figure out that shameless means without shame? The Point's cultural, religious, and linguistic sensibilities are offended.

'You are morally corrupt'

below is an open letter from an iafrica.com reader to President Jacob Zuma.Dear Mr. Zuma,

Excuse me for the casual way in which I address you, but I just can't bring myself to call you President Zuma until such time as you begin to act like one in the matters surrounding Julius Malema and many other current issues. This letter to you is just a way for me to convey my concerns, frustrations and conclusions I draw as a youngish white English-speaking South African male who, contrary to what you may think, holds only one passport. Just like my real South African white Afrikaans brethren, I too am not going anywhere and hence I keep an eye on the news and often find myself wondering how we have come to this point in South Africa.

I have a problem when an individual such as Julius Malema can live the lifestyle he does on the income he declares. I guess there is nothing new in this concern, as he has been doing it for a while now, and it has been pointed out by many in recent days.

What really concerns me though is the way that an individual who becomes the leader of the ANCYL (let's not forget that it is a division of the ANC) can become so wealthy so quickly. Given his level of education, one may be pushed to see how this is possible were it not for dealings that are not entirely above board. I am not simple, so his harping on about being "poor but creditworthy" really does not fool me. Nobody is that creditworthy. The man is obviously up to his elbows in cash and loving it. Every person is of course entitled to earn a living, but when they clearly earn significant amounts of money by doing what would seem to be very little at all, one wonders how they come by this wealth.

Let's assume for a minute that Julius is not guilty of any crime. If this is the case, why can he simply not divulge the source of his extensive wealth? We can all go on with our lives safe in the knowledge that the head of the ANC Youth League is on the straight and narrow, that he earns an honest wage, and that the president of our country is not commenting as there really is no need. If this wonderful trust fund of his is used for philanthropy, why can he not show the public the work being done and the flow of money into the fund and to the benefactors? If this trust fund is receiving money for all this wonderful charitable work from above-board sources, why can these not be listed? Surely they'd be honoured? I would be!

Now before you answer that, I know that his private affairs are just that, but one would think that there is a fantastic opportunity in this for Mr. Malema. Imagine his popularity jump should he be publicly shown to be both fully accountable and donating to the poor and needy. Imagine the political benefits of such a windfall revelation! Surely any politician's dream come true, and an opportunity to cherish and embrace?
But here we have the crunch. For what I believe to be the very same reason that you went to Mauritius to legally withhold evidence from a court of law, Mr. Malema went to court in an attempt to get an injunction against the press to muzzle the story about the trust fund. (Where's that blasted Protection of Information Bill when you need it!) I can only think that this is because you are both guilty of illegal activity. Why would you want to hide Mauritian documents if they did not implicate you in wrong-doing? Why would Julius want to hide his trust fund if it did not take the public one step closer to knowing about the source of his no doubt ill-gotten wealth? There really is not an answer that suits either of you and hence the silence.
Same with our top cop? It seems to me that you are both playing a game here which involves making use of valid legal processes to avert the course of justice. Of course, we as South Africans take seriously the principle of innocent until proven guilty, but what astounds me is the way that people, and in particular certain politicians, seem to think that their legal status is their actual status. There is a difference between guilt in reality and in a court of law. Every person who commits a crime is guilty of that crime and hence a criminal. They may be prosecuted and let off on a technicality, or never be prosecuted at all in a court of law, and thus legally they may remain innocent. In reality they are however still criminals, and the very fact that both you and Julius need to resort to "legal games" to avoid the truth implies (at least in my mind) that you are criminals. An understandable, simple and logical conclusion, and forgive me if I'm wrong.

I am concerned that the very man sworn in to uphold the values entrenched in our constitutional democracy is so very quiet about the corruption and fraud that is becoming more and more obvious to any sensible South African. Is this simply because you are morally bankrupt? The more I worry about this the more I come to the realisation that you may actually not care about South Africa, its constitution or its people. The threats you made to Vrischgewacht voters during our last election that their ancestors would be unhappy with them should they not vote ANC are proof to me that the concept of modern democracy is not something you take seriously. This kind of threat is cultural blackmail, and I am saddened that with the constitution we have, you were not impeached for such a statement.
So there you go. Ignoring all the other alleged failings of both yourself and of Julius Malema; ignoring all the finer details; ignoring all the legal mumbo jumbo, these simple deductions from irrefutable facts are what damn both of you. It is now clearer than ever before that illegal and immoral activity is not only condoned by you, but also appears to be your modus operandi. It is clear that the current crop of ANC politicians and supporters are all just as guilty by association, by condoning this behaviour through their deafening silence and by putting you there in the first place.

I personally believe that every single one of you are morally corrupt, and having a morally corrupt party at the helm of this country is a worrying thing for a guy with one passport who is simply trying to make ends meet, and make a future for himself and his family in this frustratingly lovely country.

I may of course be wrong, but I believe that the history books will not be kind to you, that you are a poor president, and the values you represent and condone are damaging to South Africa, its reputation and its people. Were you a real man of honour, I'd think you'd step down, but I guess that whilst the money is good, that's too much to ask.

One final suggestion, and that is that you and Julius are going to need to get your stories straight. Your ancestors are going to have some difficult questions lined up for you guys when you finally move on, and who you voted for will be the least of your problems! Die poppe gaan lekker dans, ouboet! If they don't in this life, they will in the next; if of course you believe in that kind of thing!

Janusz Waluś



Janusz Waluś (born 1953 in Zakopane, Tatra County) is a Polish immigrant to South Africa who assassinated South African Communist Party chairman Chris Hani on April 10, 1993.

The timing of the event, just prior to the first democratic elections in South Africa, caused considerable political tension in the country. Only Nelson Mandela's personal pleas for calm were able to defuse the situation.

The assassination was ultimately unsuccessful at derailing the dismantling of apartheid. For the murder Walus and his accomplice, Conservative MP Clive Derby-Lewis, were sentenced to death, but later commuted to life imprisonment following the abolition of the death penalty in South Africa in 1995.

Chris Hani



Chris Hani, born Martin Thembisile Hani (28 June 1942 – 10 April 1993) was the leader of the   South African Communist Party and chief of staff of  Umkhonto we Sizwe, the armed wing of the African National Congress  (ANC). He was a fierce opponent of the apartheid government. He was assassinated on 10 April 1993.


Early Life

Hani was born on 28 June 1942 in the small town of Cofimvaba in a rural village called kuSabalele Transkei. He was the fifth of six children. He attended Lovedale school and later studied modern and classical literature at the University of Fort Hare.

Political Career


At age 15 Hani joined the ANC Youth League. As a student he was active in protests against the Bantu Education Act. Following his graduation, he joined Umkhonto we Sizwe (MK), the armed wing of the ANC. Following his arrest under the  Suppression of Communism Act, he went into exile in Lesotho in 1963. He received military training in the Soviet Union and served in campaigns in the Rhodesian Bush War in what is now Zimbabwe. In Lesotho he was the target of assassination attempts, and he eventually moved to the ANC's headquarters in Lusaka, Zambia. As head of Umkhonto we Sizwe, he was responsible for the suppression of a mutiny by dissident ANC members in detention camps, but denied any role in abuses including torture and murder.


Joe Slovo

He returned to South Africa following the unbanning of the ANC in 1990, and took over from Joe Slovo as head of the South African Communist Party in 1991. He supported the suspension of the ANC's armed struggle in favour of negotiations. However, he stated that he would not rule out violence in a speech on National television shortly before his death.

Assassination



Chris Hani was assassinated on 10 April 1993 outside his home in Dawn Park, a racially-mixed suburb of Boksburg. He was accosted by a Polish far-right immigrant named Janusz Waluś, who shot him in the head as he stepped out of his car. Waluś fled the scene, but was arrested soon afterwards after Hani's neighbour, a white woman, called the police. Clive Derby-Lewis, a senior South African Conservative Party M.P., who had lent Waluś his pistol, was also arrested for complicity in Hani's murder.

Hani's assassination was part of a plot by the far-right in South Africa to derail the negotiations to end apartheid.

Historically, the assassination is seen as a turning point. Serious tensions followed the assassination, with fears that the country would erupt in violence.

Nelson Mandela addressed the nation appealing for calm, in a speech regarded as 'presidential' even though he was not yet president of the country:
“Tonight I am reaching out to every single South African, black and white, from the very depths of my being. A white man, full of prejudice and hate, came to our country and committed a deed so foul that our whole nation now teeters on the brink of disaster. A white woman, of Afrikaner origin, risked her life so that we may know, and bring to justice, this assassin. The cold-blooded murder of Chris Hani has sent shock waves throughout the country and the world. ... Now is the time for all South Africans to stand together against those who, from any quarter, wish to destroy what Chris Hani gave his life for – the freedom of all of us.
”
While riots did follow the assassination, the two sides of the negotiation process were galvanised into action, and they soon agreed that democratic elections should take place on 27 April 1994, just over a year after Hani's assassination.

Assassins' conviction and amnesty hearing

Gaye Derby-Lewis

Both Janusz Waluś and Clive Derby-Lewis were sentenced to death for the murder. Clive Derby-Lewis's wife Gaye Derby-Lewis, also a senior Conservative Party figure, was acquitted. The two men's sentences were commuted to life imprisonment when the death penalty was abolished as a result of a Constitutional Court ruling in 1995.

Hani's killers appeared before the Truth and Reconciliation Commission (South Africa), claiming political motivation for their crimes and applying for amnesty on the basis that they had acted on the orders of the Conservative Party. The Hani family was represented by anti-apartheid lawyer George Bizos. Their applications were controversially denied when the TRC ruled that they were not acting on orders. They are still in prison, parole having been denied most recently by the Cape High Court on 17 March 2009. Latest news on their release - click here.

Conspiracy theories surrounding assassination

Hani's assassination has attracted numerous conspiracy theories about outside involvement. The final report of the Truth and Reconciliation Commission, however, said that it "was unable to find evidence that the two murderers convicted of the killing of Chris Hani took orders from international groups, security forces or from higher up in the right-wing echelons."

Influence

Hani was a charismatic leader, with significant support among the radical anti-apartheid youth. At the time of his death, he was the most popular ANC leader after Nelson Mandela, and was sometimes perceived as a rival to the more moderate party leadership.  Following the legalisation of the ANC, Hani's support for the negotiation process with the apartheid government was critical in keeping the militants in line.

Chris Hani's killers, could apply for parole

 A ruling by the North Gauteng High Court on Tuesday means that Eugene de Kock, Clive Derby-Lewis and Janus Walus could now apply for parole, Eyewitness News reported a lawyer as saying, on Wednesday.

EWN reported that on Tuesday, the court ruled that it was unconstitutional for the correctional services department to abolish a system of credits that allowed prisoners, sentenced to life in jail before 2004, to work towards an early release.

Lawyer Julian Knight brought the application on behalf of Cornelius Van Wyk who had been allowed to gain credits to apply for parole.

Van Wyk was sentenced in September 2004 to three life sentences for murder committed during his involvement with a right-wing organisation.

Knight reportedly said that the ruling means the correctional services regulation pertaining to this has now been struck down.

As a result people sentenced to life in jail before 2004 can now apply for parole.
Derby-Lewis and Walus have been sentenced to life behind bars for the murder of former SA Communist Party leader.

Cele - nobody's buying it .

I see! He's was investigating incompetence, maladministration and unlawful conduct in 2009. A year later he decided to do it also.

National police commissioner General Bheki Cele asked the Special Investigating Unit (SIU) to investigate the way certain contracts for construction, uniforms and equipment were granted within the SA Police Service, according to a report in The Star on Wednesday.

Cele said the SIU probe was in terms of a presidential proclamation signed by President
Jacob Zuma in July and August last year.

He said he met SIU head
Willie Hofmeyr in November 2009 to request an urgent investigation into the supply chain management division, and later learnt that the SIU was sitting with a similar request from the police's Independent Complaints Directorate, lodged in May 2009.

No reference was made in the article to the public protector's recent findings that as the accounting officer, Cele, with Public Works Minister
Gwen Mahlangu-Nkabinde, were accountable for the approval of two multimillion rand leases for police headquarters which the protector said were concluded improperly.

R4bn worth of inflated tenders

According to Wednesday's report, 33 police stations at a cost of R330m are currently under scrutiny by the SIU as well as three former police generals, who allegedly benefited from R4bn worth of allegedly irregularly awarded and inflated tenders.

Cele cited three matters: the Inanda police station, which was supposed to cost R15m, Pienaar police station in Mpumalanga which was to cost R40m and a police station in KwaMaphumulo, which would cost R7m to build from foundation to finish.

Inanda and Pienaar cost R134m and KwaMaphumulo was not built. Where did the other R72m go to????

Other contracts include goods and services provided to the forensic science laboratory; the procurement of certain leases for the police; the procurement of information management systems; the manufacturing and supply of police uniforms and alleged irregularities in awarding a R1bn radio communications tender in the Eastern Cape.

"The SAPS has nothing to show for the more than R900m that has already been spent on a contract to provide radio communication services to the Eastern Cape, yet more money was being allocated to this contract despite the fact that no one could tell me, as the accounting officer, why this service was needed in the SAPS in the first place," Cele was quoted as saying.

He said police leadership had also decided to use retrenched textile workers to provide uniforms for the police, but then found that a contract to a private company, which had expired when the decision was taken, was extended to expire in 2013.

He said the extraordinarily high cost of police stations needed to be investigated and that police stations built by one company, Midway Two, had paid up to four times the original amount, according to The Star.

Shocked

Cele said: "To say I was shocked by the state of affairs in this division would be the understatement of the century. Contracts were signed without any members of the bid committee actually sitting down for a meeting. Instead, members of the committee would sign their approval of tender awards from wherever they each would be at a particular point in time. Some of the contracts were signed in 2009 and only meant to be effective from April 2012," Cele said.

The report named three former policemen as being investigated: Lieutenant General Hamilton Hlela a deputy national police commissioner and head of the police's supply chain management; Lieutenant General Matthews Siwundla and Major General Stefanus Terblanche.

Cele decided to remove them from the supply chain environment and so Hlela and Terblanche offered to resign and Siwundla asked for early retirement.

"I signed the directive terminating their services for one reason only: To bring efficiencies to the service," he said.

When contacted for comment, Hlela and Siwundla said there were no irregularities with the contracts.
The Star reported that SIU spokesperson Karam Singh confirmed the investigation was focused on the officials and would only say the unit was aware of the allegations against Midway Two.

Cele has cancelled two press briefings intended to provide an official response to the protector's findings. Media queries on the matter were removed from the police and redirected to government spokesperson
Jimmy Manyi, and then to newly appointed spokesperson for Zuma, Mac Maharaj.

On the eve of a press conference by Public Protector
Thuli Madonsela, thought to have been to provide her findings on the lease probe, The Star ran a report that Madonsela was about to be arrested for corruption but Police Minister Nathi Mthethwa and Cele said this was a surprise to them.

Maharaj told Sapa on Wednesday that processes relating to Madonsela's report were under way.

The relevant ministers have been written to by Zuma so that internal processes could be taken up with "urgency and seriousness".

Asked when a response would be made public, he could not say, but it would be within timelines set down.

"We are clear that we are treating the public protector's report as a serious report," said Maharaj.

Cele plane bill soars to R1.5m

National police commissioner General Bheki Cele has spent at least R1.498m on flights with the SAPS since August 2009, Police Minister Nathi Mthethwa said on Tuesday.

In a written reply to a parliamentary question by the Democratic Alliance's Dianne Kohler Barnard, he said Cele had jetted around 47 times by May 30 this year.

While most flights were domestic, to all corners of the country, he also flew to Malawi, Angola, Namibia, and Zimbabwe in the jet, Mthethwa said.

In a statement later, Kohler Barnard lambasted the embattled police chief and again called for his dismissal.

No reason given for trips

Mthethwa had not disclosed the purpose of these trips, nor did he indicate why Cele could not travel using a commercial airline in each instance.

Recently, Cele's conduct regarding the "dodgy" police lease deals had been found by the Public Protector
Thuli Madonsela to be unlawful, improper, and constituting maladministration, she said.

"This latest revelation underscores the disregard that Commissioner Cele has repeatedly displayed for accountability, professional conduct, and prudent use of State funds.

"It is unclear what more evidence President
Jacob Zuma needs before Commissioner Cele is dismissed."
Reckless spending


In less than one month, Cele racked up a bill of R150 000 on three separate trips from OR Tambo International, Johannesburg, to Cape Town.

Three such business class trips on SAA would have equalled less than a tenth of that cost.

In terms of the Public Finance Management Act (PFMA) the accounting officer of an institution should exercise all reasonable care to detect unauthorised, irregular, fruitless, and wasteful expenditure, and should for this purpose implement effective, efficient, and transparent processes of financial and risk management.

Cele was the police’s accounting officer, and his about R1.5m plane bill constituted reckless expenditure, Kohler Barnard said.
